Deficiency Citations Will be Given for Lack of Appropriate Sprinkler Systems in Nursing Homes

In 2008 the Department of Health & Human Services mandated that all nursing homes must have automatic sprinklers installed by August 13, 2013. This provided a five-year phase-in the new rule entitled “Medicare and Medicaid Programs: Fire Safety Requirements for Long Term Care Facilities, Automatic Sprinkler Systems”.  This process will not require any new surveys of the sprinkler systems but when time comes for re-certification, citations will be given for deficiency and can lead to reimbursement issues. If a facility does not conform to the regulation of having sprinklers systems in place, it will be cited with deficiency tag K056 during surveys. Facilities that receive this citation will be required to submit a plan of correction as to how they will fix the deficiency within three months.

Facilities that have completed plans for installation in place will not be imposed a citation or a civil monetary penalty.  The memorandum also details various categories of sprinkler systems that could warrant a citation and the deficiency's severity. Many of the sprinkler deficiencies will be cited as a “potential for harm” and have a severity level of D, E, or F, at a minimum.
